What is Small Claims Court?

The Small Claims Court is a branch of the Superior Court of Justice. It has civil jurisdiction for monetary claims up to $25,000. Some matters are heard by Small Claims Court judges who are appointed by provincial government. The majority of matters are heard by Deputy Judges. The Small Claims Court Rules came into force on July 1, 2006. The Rules are less complex and guides to procedures are available from the Ministry of the Attorney General of Ontario. The Small Claims Court provides an informal and inexpensive process for settling disputes. To ensure the simplicity of the process, the court will only entertain monetary and property claims up to $25,000. There are 90 Small Claims Courts in Ontario, with jurisdictions in Toronto, Brampton, Mississauga, Scarborough, Oakville, North York, Markham, and Burlington. In Toronto small claims court and Brampton small claims court are high volume courts which may mean a longer time to obtain a trial date, however matters heard for Mississauga are still heard in the Toronto small claims court. There are actually two small claims courts in Brampton, which are located very close to each other.

Court staff only provide limited assistance with court forms and procedures. There is way more to litigation than completing and filing forms and many self-represented litigants have a false sense of security after they complete forms but have limited or no experience with the rules, law and procedure. Small Claims Court is not like popular daytime court television programs, it is a matter to be taken seriously and requires qualified advice and guidance.
